Ben Stokes has been provisionally named in England's one-day squad to take on Australia in the New Year.
The all-rounder was left out of the Ashes squad due to his involvement in a brawl outside a Bristol nightclub in September.
Video footage emerged allegedly showing Stokes repeatedly punching another man in an incident where England teammate Alex Hales was also present.
The latter will not face any criminal charges, but no confirmation has been made regarding Stokes, who was arrested on suspicion of causing actual bodily harm.
Both cricketers have been selected for the ODI series in January, but the ECB claims that "their involvement remains subject to any relevant legal or disciplinary developments in relation to the incident in Bristol in September".
Meanwhile, Sam Billings and Mark Wood have been named in the 16-man squad for the series, which will begin with the first ODI on January 14.
